New Clarification from the European Commission: Esca Cap

The European Commission has recently shared further information regarding the application of the Esca caps as defined in the Implementing Regulation (EU) 2022/996. Indeed, in a recent exchange with voluntary schemes, the European Commission has indicated that any Esca claims that took place prior to the application of the new sustainability certification rules do not have to comply with the caps set out in the Implementing Regulation (EU) 2022/996. Thus, the rules set out in the Implementing Regulation (EU) 2022/996 would not apply to the certification of any biomass that was claimed before December 29, 2023, regardless of whether this biomass was processed before or after December 29, 2023. This information updates the previous communication sent on December 12, 2023.

2BS guidelines validated by the European Commission

We are pleased to inform you that as of January 3rd, 2024, the European Commission has officially validated the updated 2BSvs certification guidelines. These revisions encompass procedures, standards, and checklists, aligning them with the legal requirements from the Implementing Regulation (EU) 2022/996. All pertinent documents for both the biofuel and the biogas supply chains are now available for your reference on our dedicated page. Additionally, we updated all pertinent checklists and the Greenhouse Gas emissions Calculator to reflect the new guidelines. These documents are effective immediately – all audits, initial or renewal audits, must comply with the new 2BS documents. Please note that existing 2BS certificates will remain valid until their renewal audit dates, preventing the need for immediate re-certification

Update NUTS2-values – biofuels and bioliquid supply chain

Dear economic operators and certification bodies, Concerning our recent joint communication on NUTS2 (1) values, we’d like to update the available information after we received a letter from the European Commission on this matter on Tuesday 12th December 2023. In this letter the Commission confirms its position “…that since the entry into force of Directive (EU) 2018/2001 (RED II) the NUTS-values submitted under Directive 2009/28/EC [‘old NUTS values] are no longer automatically applicable and promised to investigate whether a further transition period would still be possible. …” As a result of this investigation, the Commission states in its latest letter that “…NUTS-values differing from the default values for Annex V can therefore only be applied if recognised by the Commission

Thanks to this equivalence, 2BS customers can now easily value their sustainable products in the food market. The SAI (Sustainable Agriculture Initiative) is renowned for having developed a Farm Sustainability Assessment (FSA) tool. This program enables sustainability certifications to be benchmarked with the FSA standards, highly valued in the food sector. To support our customers by opening new markets to their sustainable raw materials, 2BS did the self-assessment process to evaluate 2BSvs and 2BSXtra certifications regarding the FSA criteria. 2BS joins RSB Impact Alliance to scale sustainability performance across supply chains

The Roundtable on Sustainable Biomaterials (RSB) and the 2BS Association (2BS) have signed a Memorandum of Understanding (MoU) to scale trusted sustainability certification across aviation and materials supply chains. This collaboration is part of the RSB Impact Alliance project. The association of both organisations through the RSB Impact Alliance aims to support farmers, brands and industrial end-users to develop consistent and streamlined certification approaches for entire supply chains, covering different feedstocks and markets. Together, RSB and 2BS envision a simplified certification process for operators to scale sustainability performance and the transition to net zero.
