Clarification on the Status of Waste Starch Slurry under the RED Framework

As starch-derived materials gain interest as feedstocks for biofuel and biogas production, 2BSvs reminds operators of the correct classification rules under the Renewable Energy Directive (RED).

Waste starch slurry cannot be considered a waste or residue if it is deliberately produced or is the main intended output of a process (for example, following the separation of waste starch slurry from refined starch). This refined starch must necessarily have a food or feed outlet for the waste starch slurry to be classified as a residue. Otherwise, it must be classified as a (co-)product.

This reminder aims to ensure proper feedstock classification and prevent misreporting or non-compliance during certification.

‘waste’ means waste as defined in point (1) of Article 3 of Directive 2008/98/EC, excluding substances that have been intentionally modified or contaminated in order to meet this definition;

‘residue’ means a substance that is not the end product(s) that a production process directly seeks to produce; it is not a primary aim of the production process and the process has not been deliberately modified to produce it.
